The Prosecutor

The prosecutor's job in a court case is to find the accused defendant guilty of the crime that he or she is said to have done. This also means that the prosecutor must try to go for the hardest sentence possible especially if the individual accused of a crime is a threat to the general population. A prosecutor represents the people and when the people's rights are infringed upon, the prosecutor must do his job to protect and defend the rights of the people. Many times, the prosecutor is up against legal defense dream teams. In the case of O.J. Simpson, the prosecution had their own team as well but it was no where the same caliber as the one that Mr. Simpson had. Besides, the pay of a prosecutor is no where near the pay of a defense lawyers. It is realistic to state that the entire prosecution's annual salary is not even the same amount as that of a single salary of the defense team's. The prosecutor must also do a lot more research than a defense attorney. For one thing, the prosecutor must prove to the jury that a person is actually a criminal. Proving somebody to be a criminal is not an easy process because there are many loop holes that can be found in a case. Even a person or suspected group that has a mound full of evidence can be hard to prove guilty.


Another case that is a Hollywood invention is that of the movie Fracture.  In Fracture a guy, Anthony Hopkins murders his wife however all the evidence that is presented in the murder investigation and case is immediately thrown out and unusable.  The maverick attorney from the prosecutor’s office is having trouble finding new evidence to convict Hopkins.  In this type of case, the people are trying to convict somebody however this kind of case would have a lot of complexities.  For one thing, if a prosecutor gets the first try wrong, then the whole case can never be revisited.  The case can not be brought back up again due to Double Jeopardy.  Double Jeopardy means that a person can not be tried for the some crime twice.  So, if a person is tried for a crime and is not convicted the first time, this person can not be tried for the same crime again.  Of course, this clause does not work for robbery however, the best example is murder.  For instance, O.J. Simpson can never be tried for the suspected murder of his wife ever again.  If this right was not placed in effect, the District Attorney would get multiple chances to convict a person and different sets of juries each time.


A prosecutor must like helping the people and ensuring that the people's rights are not affected or a person tries to take away another's rights. This is why a prosecutor becomes a prosecutor because he or she wants to ensure the rights of the people more than the person wants to make a lot of money.
